Warranty

Americas Most Wanted 4x4, LLC (“AMW”) warrants its Conversion Packages (“Conversion Packages”) against defects in materials and labor.  Each Conversion Package installed by AMW comes with a three (3) year/36,000 mile warranty on conversion package parts, and a one (1) year warranty on labor, beginning on the date of installation.  Each Conversion Package installed by an AMW certified distributor, comes with a three (3) year/36,000 mile warranty on conversion package parts (warranty on labor subject to certified installer terms and conditions).  Each suspension, axle, steering part, or other parts (collectively, “Parts”) not installed as part of a Conversion Package by AMW, or an AMW certified distributor, comes with a one (1) year warranty on materials beginning on the date of delivery.  Conversion Packages and Parts are collectively referred to as “Products.”

 

Process

During the applicable warranty period, and in the event that an issue with the Products cannot be resolved by telephone or email, and upon pre-authorization in writing from AMW, the parties shall cooperate to determine the most efficient method to resolve the issue, which may include the following:

 

• If AMW installs the Conversion Packages at their facility, Customer will initiate the warranty process with AMW and will ship, freight prepaid, or deliver the Conversion Packages to AMW for service.  All shipping and insurance expenses to and from AMW during the warranty period shall be borne by the Customer, but may be covered by AMW for reimbursement solely at AMW discretion.  AMW will not be held responsible for improper handling or any other damage incurred in transit.  AMW will cover the costs of repair or replacement of conversion package parts and labor.

• If an AMW certified distributor installs the Conversion Packages, Customer will initiate the warranty process with the AMW certified distributor and will ship, freight prepaid, or deliver the Conversion Package to the certified distributor service center that performed the installation for service.  All shipping and insurance expenses to and from AMW during the warranty period shall be borne by the Customer, but may be covered by AMW for reimbursement solely at AMW discretion.  AMW will not be held responsible for improper handling or any other damage incurred in transit.  AMW will only cover the costs for repair or replacement of conversion package parts.

• If Parts are not installed by AMW, or an AMW certified distributor, then Customer will ship, freight prepaid, or deliver the Parts to AMW or a certified distributor for service.  All shipping and insurance expenses to and from AMW or the certified distributor during the warranty period shall be borne by Customer.  AMW will not be held responsible for improper handling or any other damage incurred in transit.  AMW will cover the costs of repair or replacement of conversion package parts.

 

 

Limitations

The warranty is void if Products have been damaged by accident, unreasonable use, neglect, unauthorized and/or improper service, or other causes not arising out of defects in materials or labor. The warranty does not cover damage caused by normal wear and tear, or neglect or lack of proper maintenance or proper installation. The warranty applies to the original distributor and its customers only.

TO THE EXTENT PERMITTED BY APPLICABLE LAW, AMW SHALL NOT BE LIABLE FOR ANY LOSS OF USE OF ANY PRODUCTS OR OTHER DIRECT, INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES, COSTS OR EXPENSES INCURRED BY THE DISTRIBUTOR OR ANY CUSTOMER IN CONNECTION WITH ANY BREACH OF WARRANTY AND/OR DEFECTS IN MATERIALS OR LABOR.  AMW’S ENTIRE LIABILITY AND RESPONSIBILITY IS LIMITED TO THE REPAIR OR REPLACEMENT OF ANY PRODUCTS THAT CONTAIN DEFECTS IN MATERIALS OR LABOR IN ACCORDANCE WITH THIS WARRANTY STATEMENT.
